End-User License Agreement

This End-User License Agreement (“EULA”) is a legal agreement between you (“User”) and David Dias Digital (“David Dias Digital”) for the use of MouseViz (“Software”). By installing or using the Software, you agree to be bound by the terms of this EULA. For general terms governing your use of MouseViz, please also review our Terms of Service.

1. License Grant

David Dias Digital grants you a non-exclusive, non-transferable, limited license to install and use the Software on devices that you own or control, subject to the terms of this EULA. The license is granted per seat, meaning each individual user requires their own license. You may install the Software on multiple devices owned by the same user under a single license.

2. Prohibited Activities

You may not:

• Copy, modify, distribute, sell, or lease any part of the Software
• Reverse engineer, decompile, or disassemble the Software, except where applicable law expressly permits
• Remove, alter, or obscure any proprietary notices on the Software
• Use the Software for any unlawful purpose or in violation of any applicable laws
• Sublicense, rent, or lend the Software to third parties without written consent from David Dias Digital
• Attempt to circumvent any license key mechanism or usage restrictions

3. User Suggestions

If you provide David Dias Digital with any feedback, suggestions, or recommendations regarding the Software (“Suggestions”), you grant David Dias Digital a perpetual, irrevocable, worldwide, royalty-free license to use, reproduce, modify, and incorporate such Suggestions into the Software or any other products without obligation or compensation to you.

4. Modifications & Updates

David Dias Digital may, at its sole discretion, release updates, patches, or new versions of the Software. Access to updates is included with your license for a period of one year from the date of purchase. After this period, you may continue to use the version you have installed, or renew your update entitlement to receive further updates. David Dias Digital reserves the right to modify the Software at any time.

5. Termination

This EULA is effective until terminated. David Dias Digital may terminate your license if you fail to comply with any term of this EULA. Upon termination, you must cease all use of the Software and destroy all copies in your possession. Sections 3, 6, 7, and 8 shall survive termination.

6. Disclaimers

The Software is provided “as is” without warranty of any kind, express or implied, including but not limited to the warranties of merchantability, fitness for a particular purpose, and non-infringement. David Dias Digital does not warrant that the Software will be error-free, secure, or that it will meet your specific requirements. You use the Software at your own risk.

7. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall David Dias Digital be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of or inability to use the Software. David Dias Digital's total liability shall not exceed the amount paid by you for the Software license in the twelve months preceding the claim.

8. Governing Law

This EULA is governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any disputes arising out of or in connection with this EULA shall be subject to the exclusive jurisdiction of the courts located in Toronto, Ontario, Canada.

9. Export Compliance

You agree to comply with all applicable export and re-export control laws and regulations when using the Software. You may not export or re-export the Software to any country, entity, or person prohibited by applicable laws.
