MouseViz - Terms of Service

1. Acceptance of Terms

These Terms of Service (“Terms”) govern your use of the MouseViz application (“Software”). By installing or using MouseViz, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Software.

2. Eligibility

You must be at least 16 years of age to use MouseViz. If you are under 16, you may only use the Software with the consent of a parent or legal guardian. By using the Software, you represent that you meet these requirements.

3. License Grant

We grant you a personal, non-exclusive, non-transferable, limited license to use MouseViz on macOS devices owned or controlled by you, in accordance with these Terms. For detailed licensing terms including per-seat licensing and update entitlements, please refer to our End-User License Agreement.

4. Restrictions

You agree not to:

  • Decompile, reverse engineer, or attempt to derive the source code of MouseViz.
  • Modify, adapt, or create derivative works based on the Software.
  • Distribute, sell, or rent the Software to third parties without our written consent.
  • Use the Software for any unlawful purpose.

5. User Responsibility

You are responsible for any visualizations you create and any sessions you save using the Software. MouseViz is provided to assist in visualization and is not intended for capturing sensitive information without permission.

6. Intellectual Property

MouseViz and all related trademarks, logos, and content are the property of David Dias Digital. Nothing in these Terms transfers any intellectual property rights to you. You retain ownership of the visualizations, heatmaps, recordings, and other content you create using the Software.

7. Payment and Refunds

All purchases are processed by Paddle, which acts as our Merchant of Record. Prices are as displayed at the time of purchase. Refunds are handled by Paddle in accordance with their Checkout Buyer Terms. Your license includes one year of free updates from the date of purchase. After this period, you may continue using the version you have installed or renew your update entitlement.

8. Updates & Maintenance

We may provide updates to MouseViz to improve performance, add features, or fix bugs. These updates may be downloaded and installed automatically or manually.

9. Termination

We may terminate or suspend your license if you violate these Terms. Upon termination, you must cease all use of the Software and delete all copies. The following sections survive termination: Intellectual Property, Disclaimer of Warranty, Limitation of Liability, Governing Law, and any accrued obligations.

10. Disclaimer of Warranty

MOUSEVIZ IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE SOFTWARE WILL BE ERROR-FREE OR UNINTERRUPTED.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF YOUR USE OF THE SOFTWARE.

12. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Toronto, Ontario, Canada.

13. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via our website. Your continued use of the Software following such changes constitutes your acceptance of the new Terms.

14. Severability and Entire Agreement

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force. These Terms, together with our End-User License Agreement and Privacy Policy, constitute the entire agreement between you and David Dias Digital regarding the use of MouseViz.
